Real Estate Contract - Relocation?
Q. I entered into a real estate contract with a non-refundable deposit, for a condo unit under construction. 1 year after entering into the contract, I relocated for work, with about 8 months left on the construction. The contract did not specifically address this condition. Without reviewing the contract, is there any likelihood I can get my deposit back? Would the builder have any recourse other than keeping my deposit if I do not follow through with the purchase? Is there any terminology I should look for in the contract that may help me out of the contract? Thanks! Jurisdiction would be Tennessee, FYI. The contract did state that it was non-assignable. No upgrade were chosen. Total "reservation"/down payment was 3% of purchase… [cont.]

A. If it's non-refundable, you may have no loophole. A minimal $500 "reservation fee" would have been more appropriate. Were there upgrades covered in this non-refundable deposit? If so, you would be out that money. Many collect for upgrades in advance and those are usually non-refundable. If the value has increased, you could try looking for someone to take over your position in the offer. (An assignee)
