For Sale By Owner, or FSBO (pronounced /ˈfɪzboʊ/), is the process of selling real estate without the representation of a real estate broker or real estate agent. Homeowners may employ the services of marketing or online listing companies or market their own property but do not pay a commission and represent themselves with the help of a lawyer throughout the sale. In the US the agent's fee typically makes up 6% of the selling price of the property. If a buyer who is represented by an agent is interested in a FSBO home, that buyer's agent may request the owner pay him or her a commission, or finder's fee, for bringing the buyer. If no agreement is in place with either the home buyer or the owner of the FSBO property, the buyer's agent may not necessarily be compensated in the transaction. Well, if you haven't signed anything yet, you have no agreement b/c verbal agreements are not legal in real estate. You need to contact a local real estate attorney who will draw up a sales agreement. You CANNOT draw up your own b/c that is practicing law without a license and makes the contract voidable. The major problem is that you need to do a contract with an appraisal and financing contingency b/c you have no idea if your offer was under or below current market value for the area. Q. I keep hearing that buyer's agents won't show my FSBO house (even though its listed on the MLS) because in the end it's more work for them than working with a listing agent. I thought that by listing it FSBO we were the ones taking on the responsibilities of the listing agent. We've never sold a house before, but we bought by owner and it was pretty simple--and even seemed so from the other end of the table. Not all FSBO's are the same. The laws governing disclosure by a FSBO are more lax when it comes to disclosure. A Buyer's Agent must do more due diligence than when a property is listed by an agent. In addition, depending upon the state and its laws, the BA will have to do much of the work that a listing agent would normally take care of, doubling the work we do.
